The Ninth Wades In

Robert Alt has an excellent piece on the Ninth Circuit & California Recall on National Review Online

The Wall Street Journal reports this morning that Miguel Estrada will today withdraw his name as a nominee for a seat on the D.C. Circuit. This is a sad day for all who support an indpendent judiciary comprised of men and women who understand the proper role of federal judges in our political system. It is an embarassment for the Senate Repubicans and for the White House, who had all better realize -- and soon -- that the Democrats unprecedented filibusters must be stopped. This is a fight that matters, and which the Republicans are losing badly.
